Terms and Conditions

These terms and conditions govern the provision of building inspection services by PRO CHECK Building Reports Christchurch Ltd (referred to as “we,” “our,” and “us”). By engaging our services, you (“the client”) agree to be bound by the terms and conditions outlined herein and the requirements set forth in the New Zealand Property Inspection Standards NZS 4306:2005 (“the Standards”).

Definitions

1. Accessory Units: As defined in the Unit Titles Act, an area with a specific purpose, not part of the dwelling unit footprint, intended for use in conjunction with the main unit.

2. Ancillary Spaces and Buildings: Areas or buildings outside the main dwelling unit footprint with a specific purpose.

3. Common Property: Collectively owned areas defined under the Unit Titles Act.

4. Inspector: A qualified and experienced individual or company authorized to undertake property inspections.

5. Minor Fault or Defect: Non-urgent issues requiring routine maintenance, typical for the building’s age, type, and condition.

6. Multi-Unit Properties: Properties containing more than one dwelling unit, with collective obligations for owners.

7. Property Inspection: A non-invasive visual inspection carried out in accordance with the Standards.

8. Property Report: The report referred to in Section 3 of the Standards.

9. Reasonable Access: Areas accessible safely, with the minimum clearances specified in Table 1.

10. Significant Fault or Defect: Issues requiring urgent or substantial repairs.

11. Special Purpose Inspection: An inspection requiring expertise, defined under Section 4 of the Standards.

12. Survey: A detailed, specialized inspection requiring invasive methods or expertise.

13. Weathertightness Risk: Defined in Appendix A of the Standards.

Disclosure

Our non-invasive residential building inspections and reports are conducted in compliance with the Standards and include:

1. The scope of the inspection and report.

2. Components not covered due to inaccessibility.

3. These terms and conditions, to be read alongside our terms of engagement.

Scope of Inspection

1. The inspection is a non-invasive visual assessment of accessible building components, as per the Standards.

2. Moisture Meters may be used in accessible areas identified as risk zones. However, results are not conclusive, and further weathertightness reports may be required.

3. Methamphetamine testing (if requested) is conducted via non-invasive swab testing. Positive results may be shared with relevant stakeholders without liability to us.

Client Responsibilities

1. Access: Clients must provide reasonable access to the property, including accessory units, ancillary spaces, and common property.

2. Restricted Access: Areas that cannot be accessed will be excluded from the report. A re-inspection fee of $120.00 + GST applies if access is later granted.

3. Confidentiality: The report is for the client’s personal use and may only be shared with the vendor or agents involved in the transaction. Third parties may not rely on the report.

Limitations of Inspection

1. The inspection is non-invasive and does not include:

• Hidden or inaccessible areas.

• Underground drainage, heating efficiency, pest infestations, or hazardous materials.

• Systems not in use at the time of inspection.

2. The report is not a warranty and does not guarantee compliance with building codes, standards, or weathertightness.

3. Recommendations provided are suggestions only and must be verified by qualified professionals before remedial work begins.

Liability

1. Our liability for errors or omissions is limited to the cost of the inspection and report.

2. We are not liable for faults that are:

• Intermittent or concealed.

• Caused by incorrect information provided by the client or third parties.

3. The client acknowledges that the inspection is a general guide and not an exhaustive report.

Dispute Resolution

1. Disputes must be submitted in writing immediately.

2. Repairs to disputed areas must not be undertaken before we inspect and review the claim.

3. If the report is used to proceed with a transaction after a dispute, the client waives their right to pursue claims against us.

Payment Terms

1. Payment is due upon report completion. Late payments incur a 15% monthly fee and debt recovery costs.

2. Additional services or re-inspections will be charged as per agreement.

Ownership of Report

1. The report remains the property of PRO CHECK Building Reports Christchurch Ltd and may be shared at our discretion.

2. Cancellation within 48 hours incurs a $50 administration fee. Cancellations with less notice will be charged the full inspection cost.

General Conditions

1. This agreement is governed by New Zealand law.

2. The report does not constitute a valuation or recommendation to purchase.

3. Our services are provided on an “as-is” basis, and clients use the report at their own risk.
